Foi publicada a Portaria SPA/MF nº 561, de 08 de abril de 2024, inaugurando a Política Regulatória da Secretaria de Prêmios e Apostas do Ministério da Fazenda e delineando a Agenda Regulatória de 2024.
O propósito fundamental dessa regulamentação é estabelecer a base normativa para a atividade de apostas de quota fixa, além de definir as etapas prioritárias desse processo.
Na portaria, os objetivos da Política Regulatória da Secretaria de Prêmios e Apostas são: (1) estabelecer ações regulatórias consideradas prioritárias; (2) proporcionar segurança jurídica, previsibilidade e eficiência ao processo de regulação das apostas de cota fixa; e (3) proporcionar um ambiente regulatório estável, atual, transparente e atraente para o investimento sustentável.
É determinado que a SPA-MF deverá dar prioridade aos temas listados na Agenda Regulatória para o ano de 2024 durante o planejamento e execução de suas atribuições. Isso ocorrerá sem prejuízo da possibilidade de edição de regulamentos específicos ou complementares, conforme julgado necessário pelas áreas técnicas competentes, bem como dos regulamentos emitidos por outros órgãos federais em questões de sua competência legal e institucional.
A nova política regulatória e a agenda definida pelo Ministério da Fazenda buscam trazer clareza, segurança e eficiência para o mercado de apostas, promovendo um ambiente propício tanto para o desenvolvimento do setor quanto para a proteção dos interesses dos apostadores e da sociedade em geral.

SPA/MF Ordinance No. 561, dated April 8, 2024, was published, inaugurating the Regulatory Policy of the Prizes and Betting Secretariat of the Ministry of Finance and outlining the 2024 Regulatory Agenda.
The fundamental purpose of this regulation is to establish the normative basis for fixed-odd betting activity, in addition to defining the priority stages of this process.
In the ordinance, the objectives of the Regulatory Policy of the Prizes and Betting Secretariat are: (1) to establish regulatory actions considered priorities; (2) provide legal certainty, predictability and efficiency to the process of regulating fixed odds betting; and (3) provide a stable, current, transparent and attractive regulatory environment for sustainable investment.
Attached to the ordinance is the Regulatory Agenda, divided into 4 implementation phases, as shown in the table below.
It was determined that the SPA-MF must give priority to the topics listed in the Regulatory Agenda for the year 2024 during the planning and execution of its duties. This will occur without prejudice to the possibility of issuing specific or complementary regulations, as deemed necessary by the competent technical areas, as well as regulations issued by other federal bodies on issues within their legal and institutional competence.
The new regulatory policy and the agenda defined by the Ministry of Finance seek to bring clarity, security and efficiency to the betting market, promoting an environment conducive to both the development of the sector and the protection of the interests of bettors and society in general.
